TERMS OF SERVICE
By engaging the services of VIVID STRINGS for an event, you (the Client) expressly acknowledge that you have read, understood and agree to be bound by the below Terms and Conditions (T&Cs). You explicitly acknowledge that VIVID STRINGS will only attend, perform and provide services at an Event on the condition that you have agreed to the following T&Cs.
PAYMENT
We require a non-refundable $200 deposit in order secure the booking and our musicians. An invoice will be issued to you at the time of booking. The remaining balance on the account is due 21 days prior to your event date. Events booked within 21 days are to be paid in full.
All payments are to be made through electronic bank transfer.
OVERTIME
If your event runs over the agreed finish time, a fee calculated in 15 minute increments at $30 per musician. It will be at the musicians' discretion whether they continue playing on the day as their availability is not guaranteed.
MUSIC REQUESTS
Requests are to be specified in writing 21 days prior to the event date. If your song/piece is not in our 'Music List' and needs to be specially sourced and arranged, there will be a nominal fee discussed with you and agreed upon. This fee will range between $15 - $30. A subsequent invoice will be issued.
CANCELLATIONS
Cancellations are to be notified by email as soon as possible. If you cancel the event with more than 21 days notice, any payment made with the exception of the deposit is refundable. After this time there will be no refund and any outstanding balance on the account must be paid.
Where full payment has not been received by the due date, we reserve the right to cancel until proof of payment has been provided.
RESCHEDULING AN EVENT
We are more than happy to accommodate any changes if you provide sufficient notice. Providing less than 21 days notice of your date change will incur a postponement fee of $100.
COVID-19 PANDEMIC POLICY
If it is impossible for you to proceed with your event on your booked dates due to Government-imposed restrictions, health orders, international or national travel restrictions, or VIVID STRINGS are unable to operate due to COVID-19 impacts, we offer a fee-free postponement of your booking to a future date. Rescheduled events are subject to availability.
In no circumstance will the booking fee/deposit be refunded. The booking fee covers all VIVID STRINGS administrative costs, including a fee payable to the artists to secure the date.
SET UP TIME & BREAKS
Our musicians arrive 15-20 minutes before start time. If the musicians are required to be set up earlier than this, an additional early set up cost will be incurred and this will be added to the invoice.
Musicians must take a 10 minute break every hour of playing. For bookings of three hours or more, a 30 minute break is required and refreshments or a meal should be provided.
SPACE REQUIREMENTS & PARKING
Each musician will need an armless, flat chair as well as sufficient lighting to read the music.
It is essential that the musicians perform in a safe area of a minimum of 4 square metres. Another safe space close to where they’re performing is appreciated so they can store their instrument cases and personal belongings.
A suitable parking area should be available for the musicians so they can safely unload and load their instruments and equipment.
OUTDOOR EVENTS
Overhead shelter to cover and protect the musicians and their instruments must be provided as weather conditions such as harsh and direct sunlight, rain and wind can hinder the performance and cause harm to the fragile and valuable instruments.
Our musicians reserve the right to move to a different area, or stop performing, if no sufficient cover is provided.
PRIVACY
The Client hereby authorises VIVID STRINGS to collect, retain, use and disclose consumer and/or commercial information about the purchaser in accordance with the Privacy Act 1988 (and its subsequent amendments) to persons or legal entities who are a solicitor or any other professional consultant engaged by VIVID STRINGS, debt collectors, credit reporting agencies or any other individuals or organisations which maintains credit references or default listings.
CONDUCT
VIVID STRINGS does not tolerate any violent, aggressive or abusive behaviour from any person at a venue where we perform at. If at any time any VIVID STRINGS musician feels that their personal safety or the safety of their instrument is under threat, then VIVID STRINGS reserves the right to terminate the event at any time. In these circumstances, no refund for the event will be provided and will be forfeited in full.
By agreeing to these T&Cs, you acknowledge and take responsibility for any harm caused to any VIVID STRINGS artist or their instrument by any person at the venue hosting the event (whether a guest or otherwise).
LIABILITY
When you engage VIVID STRINGS artists to perform at your event, you agree that the liability shall be entirely limited to an amount equal to the event invoice that you have paid. VIVID STRINGS shall not be in any way liable for any indirect or consequential damages arising from non-performance of the event under, or any other breach of, the T&Cs.
FORCE MAJEURE
VIVID STRINGS is not responsible for any failure to perform any obligation under these T&Cs if the performance has become impossible due to fire, flood, storm, earthquake, tsunami, civil disturbance, crime or pandemic.
